Busker wins right to pipe up

A BAGPIPE busker has beat a ban to keep him off the streets.
Gert Genisser was a familiar sight in Sunderland after he began performing in public more than three years ago.
But some shoppers and business owners branded him a nuisance and council chiefs took legal action to stop him playing his Spanish bagpipes in the city centre.
The 45-year-old was later convicted for playing a musical instrument without the consent of the council and breach of the peace.
But he appealed and is celebrating after the convictions were dropped at a hearing at Newcastle Crown Court.
Mr Genisser, of Symonds Yat, Ross on Wye, Herefordshire, said: "This is all I've ever wanted. I just want to get on with my life and share my music.
"Sunderland is a marvellous place and the people are fantastic. I hope to come back very soon."
Yesterday, the court heard that he could not be prevented from
performing under bylaws.
But the court also heard how legal experts would be examining the appeal.
It was said it was likely that legislation controlling public
performances could still be enforced.
Tom Terrett, trading standards and licensing manager at Sunderland City Council, said: "The case in this instance was brought by Northumbria Police, and the council, therefore, has no view upon its outcome.
"The council has a policy which encourages street entertainers to operate in the city centre after having obtained the appropriate consent."
