Jonas Gutierrez wins industrial tribunal claim against Newcastle United

Ex-Newcastle United player Jonas Gutierrez has won his industrial tribunal against the club.

The 32-year-old former Argentina winger claimed the club decided not to play him after he had beaten cancer in order to avoid having to give him a new contract.

He claimed he was left until it became impossible to reach the set amount of games which automatically triggered a new one-year deal.

Gutierrez claimed the discrimination began in December 2013, two months after he had begun treatment after being diagnosed with testicular cancer.

The club denied it, and said he had been left out by then-manager Alan Pardew purely based on performances, and the fact he didn't score enough goals.

Gutierrez told an industrial tribunal in Birmingham how Pardew had delivered the news that he was no longer wanted by Newcastle and would be allowed to leave.

He did leave on loan to Norwich City in January 2014, but returned to St James's Park and, although used sparingly, played a part in keeping the club in the |Premier League last season.

The tribunal found in favour of Gutierrez on two of his four claims, but dismissed a claim of unfavourable treatment and another of harassment related to disability.
