The 32-year-old returned to Tyneside midway through the season after being given the all-clear in his native Argentina.

An emotional Gutierrez scored in the club’s season-ending win over West Ham United at St James’s Park.

Associated Press report that Gutierrez has made the claim for disability discrimination under the 2010 Equality Act.

Gutierrez, a hugely popular figure on Tyneside, is understood to be alleging that Newcastle deliberately managed his selection so he would not reach a certain amount of appearances that would trigger a new one-year contract.

Newcastle released the Argentina international – who went on to join Deportivo La Coruna – at the end of the campaign.

Speaking at the time, Gutierrez said: “I had been there seven years, I always did my best.

“Maybe they could have told me before the end of the season so I could say thank you to the fans on the pitch after the last game.”

Gutierrez added: “I won’t be able to forgive the way I’ve been treated.”

The case will reportedly be heard at an employment tribunal in Birmingham.

Gutierrez yesterday will his old club on against Sunderland with a message on Twitter.

He tweeted: “45 minutes to win the game. Come on Newcastle.”
